The services that Manage Your Film Pty Ltd ("we/our") provides to you are subject to the following Terms and Conditions (“Terms”). By using and/or visiting our website, you signify your agreement to these Terms and our Privacy Policy, located at http://www.manageyourfilm.com ("the website"). A reference to “you”, “your” or “user/s” is a reference to any person, company or entity that accesses and/or uses our website and/or requires our services.

We reserve the right to modify or revise these Terms at any time without notice to you, and you agree to be bound by such modifications and revisions. Although, we may attempt to notify you when major changes are made to these Terms, you should periodically review the most up-to-date version on the website.

We provide a secure and personalised online production office. We offer an online headquarters for filmmakers seeking production and information management and an online solution for communicating with cast and crew worldwide.

We reserve the right to modify or terminate the services for any reason, without notice at any time.

We reserve the right to refuse service to anyone for any reason at any time.

You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links and other content that you submit, post, and display through the use of our services.

You must not use the services for any illegal or unauthorised purpose. International users agree to comply with all Victorian/Australian laws regarding online conduct and acceptable conduct.

When you create an account with us (free trial account or a paid account), you must provide current, accurate and complete information. You are solely responsible for the activity that occurs on your account, and for maintaining the confidentiality of your account password. You must notify us immediately of any unauthorised use of your account or any breach of security. We will not be liable for any losses caused by unauthorised use of your account however, you may be held liable for losses incurred by us or another party due to such unauthorised use.

We reserve the right to terminate your account without prior notice, if you are found to be in breach of these Terms.

Use of the website

You agree not to alter or modify, adapt or hack the website or any part of the website or modify another website so as to falsely imply that it is associated with our services or our website.

You agree not to create or submit unwanted email (spam etc) to any member of the services and agree not to transmit any viruses or any code of a destructive nature.

You must not abuse, harass, threaten, impersonate or intimidate other users.

You agree not to use the website for any illegal or unauthorised purpose and abide by all Victorian/Australian laws (including but not limited to copyright laws).

The website may contain links to third party websites that are not owned or controlled by us. We maintain no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites. By using the website, you expressly release us from any and all liability arising from your use of any third party websites.

We recommend you to be aware when you leave the website and to read the terms and conditions and privacy policy of each of the other websites that you visit.

By accessing the website, you agree that all matters relating to your use of the services shall be governed by and construed in accordance with Australian and/or Victorian laws (where appropriate).

• Personal or property damage of any nature whatsoever, resulting from access and use of our services;
• Any unauthorised access to or use of our services and/or any personal information and/or financial information stored therein;
• Any interruption or cessation of transmission to and from the website;
• Any bugs, viruses, or the likely which may be transmitted to or through the website by any third party;
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a results of the use of the content posted, emailed, transmitted, or otherwise made available via the website.

You agree to defend, indemnify and hold us and our officers, directors, employees, consultants and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from but not limited to:

• your violation of any term of these Terms and Conditions;
• your violation of any third party right, including without limitation any copyright, property, or privacy right.

Registration as a member of our website is free however, payment is required if a subscription is to be purchased to register a production. You are required to purchase separate subscription for each production you register. The payment system and account details are accessible at all times to enable a prompt extension of a subscription or purchase additional user log-ins for cast or crew as required throughout a production.

Note: The fees quoted below are in Australian dollars and include GST(as defined in Section 195.1 of the A New Tax System (Goods and Services Tax) Act 1999).

Regular Subscription Fee Structure:

• Production registration (includes access for one producer/administrator and 10 cast or crew members)
  • Fees:    $115 (for a 6 month subscription)
  • Fees:    $195 (for a 12 month subscription)

• Additional cast / crew
  • Fees:    $15 (for every additional 10 users)

Educational Institution Subscription Fee Structure:

Educational Institution Subscriptions cater to the needs of teachers and their student groups and are different from regular subscriptions. For further information please contact our representative at education@manageyourfilm.com

Payment is required in advance. Credit Cards are the only accepted form of online payment and this facility is not available to purchase the Educational Institution Subscriptions. Customers purchasing Educational Institution Subscriptions will need to make payment with a cheque made payable to 'Manage Your Film Pty Ltd' and only upon clearance of the cheque the subscription will be made active.

User Account Termination

The subscription automatically terminates on the expiration date. However, if you use the website for any illegal or unauthorised purpose then your subscription may be terminated by us prior to the expiration date.

Refund Policy

Once a subscription is purchased no refunds will be given. However, if due to a system error an incorrect amount is withdrawn from your account then the amount minus the fees will be refunded to you within four (4) weeks of the notification of the error.

Access to User Information

Your personal information such as names, telephone numbers, email / postal / residential addresses provided by you may be made available to other users from whom you accept an invitation for access to their production and also to other users who have accepted similar invitation/s to that production. Your personal information may also be made available to users who are invited by you to access your production/s. We understand that sharing of such information between users is common practice and important for some production work. Use of a user's personal information by another user in a non-professional manner is prohibited. You accept and agree that we are not responsible for any use of a user's personal information by other user/s in a way that is unlawful or breaches the privacy of other users.
